Tirwe Terms of Service and End User License Agreement
These Terms of Service and End User License Agreement ("Terms") govern your download, installation, access to, and use of Tirwe, including all related content, user-generated content features, AI features, support features, and any paid digital consumables or balances offered through the app.
By downloading, installing, accessing, or using Tirwe, you agree to these Terms and confirm that you are at least 18 years old. If you do not agree, do not use Tirwe.
1. Eligibility
Tirwe is intended only for users who are 18 years of age or older. You may not use Tirwe if you are under 18, if you are prohibited from using the service under applicable law, or if you have previously been suspended or removed for violating these Terms.
2. Relationship With Apple and App Store Distribution
If you download Tirwe from the Apple App Store, you acknowledge that:
- These Terms are between you and Tirwe, not between you and Apple.
- Apple is not responsible for Tirwe or its content, except as required by applicable law.
- Your use of Tirwe must also comply with the App Store terms and any applicable Apple rules.
- The Apple Standard Licensed Application End User License Agreement may apply as a baseline where required, together with these additional Tirwe terms.
3. License Grant
Subject to these Terms, Tirwe grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Tirwe on Apple-branded devices that you own or control, solely for your personal lawful use.
You may not:
- Copy, distribute, sell, lease, sublicense, or exploit Tirwe except as expressly allowed by law.
- Reverse engineer, decompile, or attempt to extract source code, except where applicable law prohibits this restriction.
- Use Tirwe in a way that interferes with other users, service operations, or platform integrity.
4. Accounts, Profiles, and Responsibility
You are responsible for the content you create, upload, request, publish, store, or share through Tirwe. You must provide truthful information where required and keep your device and account access secure.
5. User-Generated Content and Your Rights
You retain ownership of the content you lawfully create and submit to Tirwe. However, by submitting content to Tirwe, you grant Tirwe a worldwide, non-exclusive, royalty-free, revocable license, only to the extent necessary to:
- Host, store, reproduce, display, organize, and transmit the content inside the service.
- Operate requested app features, including AI-assisted formatting or trip display features.
- Review, investigate, moderate, remove, or restrict content for safety, legal compliance, or enforcement.
You represent that you have all rights necessary to submit the content and that doing so does not violate any law or third-party rights.
6. Zero Tolerance for Objectionable Content and Misuse
Tirwe explicitly does not tolerate objectionable content, abusive conduct, or misuse of any feature, including UGC and AI features. You may not use Tirwe to create, request, upload, post, transmit, promote, or facilitate content involving:
- Pornographic, sexually explicit, exploitative, or abusive sexual content.
- Content intended to cause disgust, serious discomfort, humiliation, or distress.
- Gambling, betting, unlawful lotteries, or other unlawful gaming activity.
- Drugs, illegal substances, trafficking, or promotion of unlawful drug activity.
- Political manipulation, unlawful political propaganda, extremist material, or discriminatory targeting.
- Discrimination, hate speech, racism, harassment, bullying, or degrading treatment of individuals or groups.
- Violence, threats, incitement, self-harm encouragement, or exploitation of minors.
- Fraud, spam, privacy invasion, doxxing, impersonation, or intellectual property infringement.
- Any illegal, unsafe, deceptive, or platform-prohibited use.
These restrictions apply to content you publish directly, content you submit privately, prompts you send to AI features, titles, descriptions, images, planner content, feedback, reports, and any other use of Tirwe.
7. Report, Block, Moderation, and Enforcement
Tirwe provides report and block tools so users can respond to objectionable or unwanted content.
- Block lets you hide content from your own experience.
- Report lets you send content or behavior to Tirwe for review.
By using Tirwe, you agree that we may review reported content, associated metadata, related account activity, and surrounding context to investigate abuse or policy violations.
Tirwe may, at its sole discretion and without prior notice where appropriate:
- Hide, restrict, label, remove, or refuse content.
- Suspend, limit, or terminate access to the service.
- Preserve evidence and cooperate with law enforcement or regulators.
- Take any action reasonably necessary to protect users, Tirwe, and the public.
8. AI Features and Third-Party Data Sharing
8.1 AI Features Overview
Tirwe offers optional AI-assisted features including phrase suggestions, diary polishing, and trip planning assistance. These features are powered by DeepSeek AI, a third-party artificial intelligence service operated by DeepSeek Technology.
8.2 What Data is Shared with DeepSeek AI
When you choose to use AI features, the following content is transmitted to DeepSeek AI for processing:
- Phrase Helper: The text you type (including voice-transcribed text) is sent to DeepSeek AI to generate polished travel phrase suggestions in different styles and categories.
- Diary Polish: Your diary entry text is sent to DeepSeek AI for editorial enhancement and refinement in your selected style.
- Trip Planner AI: Your destination name, trip preferences (vibe, must-see items), and any additional context you provide are sent to DeepSeek AI to generate personalized activity suggestions.
What is NOT shared: Your personal identification information (name, user ID), location data, GPS coordinates, device information, profile pictures, trip images, coin balance, purchase history, payment information, voice recordings (only transcribed text is sent), and any content you don't explicitly submit to AI features.
8.3 Your Explicit Consent and Control
By using AI features, you explicitly acknowledge and consent to your submitted content being transmitted to and processed by DeepSeek AI as described in these Terms and the Tirwe Privacy Policy. This consent is given each time you actively choose to use an AI feature.
AI features are completely optional. You may choose not to use them at any time. You can use all other Tirwe features without sharing any data with third-party AI services.
8.4 Data Security for AI Transmission
All data transmitted to DeepSeek AI is sent over encrypted HTTPS connections. We use secure API authentication to protect your content during transmission.
8.5 AI Output Disclaimer and Your Responsibility
AI-generated output may be incomplete, inaccurate, generic, biased, or unsuitable for your specific circumstances. AI may produce content that appears plausible but is factually incorrect. AI output may inadvertently resemble existing copyrighted works.
You remain solely responsible for:
- Reviewing and verifying all AI-generated content before use
- Editing AI output to ensure accuracy, appropriateness, and compliance with applicable laws
- Deciding whether to rely on, publish, or act upon AI suggestions
- Ensuring your use of AI output does not infringe third-party rights
Tirwe does not guarantee that AI output is correct, lawful, non-infringing, safe, appropriate, or fit for any particular purpose.
8.6 Prohibited Use of AI Features
You may not use AI features to create, request, generate, or attempt to generate prohibited content, including but not limited to:
- Objectionable, abusive, unlawful, or otherwise prohibited content as described in Section 6 of these Terms
- Content that violates third-party intellectual property rights
- Spam, misleading information, or deceptive content
- Content intended to harm, harass, or exploit others
- Any use that violates DeepSeek AI's acceptable use policies
Tirwe may monitor AI feature usage for abuse prevention, enforce usage limits, and take enforcement action against misuse.
8.7 Third-Party AI Service Provider
DeepSeek AI is an independent third-party service provider. DeepSeek's processing of your content is governed by their own terms of service and privacy policy, which you should review at https://www.deepseek.com.
Tirwe has selected DeepSeek AI based on their technical capabilities and data protection standards, but Tirwe is not responsible for DeepSeek AI's practices, service availability, output quality, or any issues arising from their service.
8.8 AI Feature Availability and Changes
Tirwe may modify, suspend, or discontinue AI features at any time. We may change AI service providers, adjust usage limits, modify pricing for paid AI access, or update how AI features work. Continued use of AI features after changes means you accept the updated terms.
9. In-App Purchases, Coins, and Paid Digital Features
This version of Tirwe may offer virtual coins or other digital consumables through Apple's in-app purchase system.
- All App Store billing is handled by Apple, not by Tirwe directly.
- Prices, purchase flows, renewals if any, and refund pathways are subject to Apple's rules and the App Store terms.
- Coins are digital items for use inside Tirwe only. They are non-transferable, non-sublicensable, and have no cash value unless required by law.
- Unless required by applicable law or Apple policy, purchases are non-refundable once delivered.
- Tirwe may deduct coins when you use paid digital features.
- Tirwe may change coin packages, prices, eligibility rules, and paid-feature pricing prospectively.
10. Ownership
Tirwe, its design, branding, software, visual assets, service features, and all related intellectual property, excluding your own lawful UGC, are owned by Tirwe or its licensors and are protected by applicable law.
11. Privacy
Your use of Tirwe is also governed by the Tirwe Privacy Policy. By using Tirwe, you acknowledge that personal data will be processed as described in that policy.
12. Suspension and Termination
Tirwe may suspend or terminate your access immediately if we reasonably believe you violated these Terms, created objectionable content, misused the service, endangered others, or created legal or platform risk.
You may stop using Tirwe at any time by uninstalling the app and discontinuing use, subject to any rights and obligations that must survive.
13. Disclaimers
Tirwe is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and error-free operation.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Tirwe and its affiliates, licensors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising out of or related to Tirwe.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Tirwe from claims, liabilities, losses, and expenses arising from your content, your misuse of Tirwe, your breach of these Terms, or your violation of any law or third-party rights.
16. Governing Law and Consumer Rights
These Terms are governed by the laws applicable to Tirwe's principal place of business, excluding conflict-of-law rules, except to the extent mandatory consumer protection laws in your place of residence apply and cannot be waived.
17. Changes to These Terms
We may update these Terms from time to time. If changes are material, we may provide notice through the app or another reasonable method. Continued use of Tirwe after the updated Terms become effective means you accept the revised Terms.
